Procedure type: Negotiated with prior publication of a call for competition / competitive with negotiation. ### From the notice Der Landkreis Spree-Neiße/ Wokrejs Sprjewja-Nysa führt ein Verhandlungsverfahren mit vorherigem Teilnahmewettbewerb für die Förderung der Errichtung und des Betriebes einer mobilen Wasserstofftankinfrastruktur im Gebiet des Landkreises Spree-Neiße/ Wokrejs Sprjewja-Nysa (auch „Projektgebiet“ genannt) nach den Regelungen der Verordnung über die Vergabe von Konzessionen (Konzessionsvergabeverordnung – KonzVgV) durch. Das Projekt ist aufgrund der, gemäß Richtlinie der Staatskanzlei des Landes Brandenburg vom 24. November 2020 zur Umsetzung der Finanzhilfen des Strukturstärkungsgesetzes für den Teil Investitionsgesetz Kohleregion erforderlichen und am 6. Dezember 2023 erfolgten, Entscheidung der Interministeriellen Arbeitsgruppe grundsätzlich förderfähig nach dem Strukturstärkungsgesetz Kohleregionen Artikel I - Investitionsgesetz Kohleregionen vom 8. August 2020. Mit der Ausschreibung soll die Errichtung und der Betrieb zukunftsfähiger mobiler Wasserstofftankinfrastrukturen im Projektgebiet erreicht und gefördert werden, damit eine bedarfsgerechte Wasserstofftankversorgung im Projektgebiet hergestellt und aufrechterhalten werden kann (auch „Projekt“ genannt). Aktuell bzw. parallel dazu wird bereits im Projektgebiet ein Elektrolyseur einschließlich einer dauerhaften festen Wasserstofftankinfrastruktur errichtet. Diese feste Wasserstofftankinfrastruktur wird voraussichtlich 2031 vollständig fertiggestellt bzw. in Betrieb genommen. Die Versorgung mit Wasserstoff soll bis dahin im Projektgebiet durch eine mobile Wasserstofftankinfrastruktur sichergestellt werden. Nach der Inbetriebnahme der festen Wasserstofftankinfrastruktur soll weiterhin auch eine Versorgung über die mobile Infrastruktur erfolgen und der Zuschlagsbieter den Wasserstoff dann vom Betreiber des Elektrolyseurs im Projektgebiet beziehen. Der Zuschlagsbieter darf das Projekt realisieren und kann auf Grundlage der grundsätzlich festgestellten Förderfähigkeit ggf. entsprechende Zuwendungen bei der Investitionsbank des Landes Brandenburg für die Schaffung der Wasserstofftankinfrastruktur beantragen, trägt jedoch das wesentliche unternehmerische Risiko für die Errichtung und den Betrieb der entsprechenden mobilen Wasserstofftankinfrastruktur, insbesondere das Betriebsrisiko selbst. Ob und in welcher Höhe das Projekt letztendlich gefördert werden kann, ist jedoch nicht sicher und kann insbesondere von dem Antrag des Zuschlagbieters bzw. Konzessionär und dessen Angebot abhängig sein und ist mit dem Fördermittelgeber im Rahmen der Antragstellung zu klären.
