Das Gesundheitsamt ist als untere Gesundheitsbehörde gemäß § 15 Abs. 1 BestG NRW dazu verpflichtet, vor jeder Feuerbestattung eine zweite Leichenschau durchzuführen. Mit der Durchführung einer zweiten Leichenschau soll bestätigt werden, dass kein Verdacht auf einen nicht natürlichen Tod besteht. Gemäß § 16 Abs. 5 BestG NRW ist vor der Beförderung einer Leiche oder Totgeburt in das Ausland ebenfalls eine ärztliche Untersuchung erforderlich, mit der festgestellt werden soll, ob Anhaltspunkte für einen nicht natürlichen Tod bestehen. Die zweite Leichenschau findet im Krematorium kurz vor der Einäscherung statt.
