Für die Nutzung der Stellplätze wird eine straßenrechtliche Sondernutzungserlaubnis für die Dauer von 6 Jahren erteilt. Die Stellplätze werden im Rahmen eines einheitlichen Auswahlverfahrens an einen Carsharing-Anbieter vergeben. Der Carsharing-Anbieter ist verpflichtet, auf allen 25 Stellplätzen dauerhaft ein Carsharing-Angebot während der gesamten Laufzeit der straßenrechtlichen Sondernutzungserlaubnis zu betreiben. Dabei agiert der Carsharing-Anbieter wirtschaftlich selbstständig. Er trägt das wirtschaftliche Risiko der Unternehmung und leistet die Administration und Disposition. Er trägt die Verantwortung für ein wirksames Marketing des Carsharing-Angebotes. Die Abrechnung des Carsharing-Angebots hat exakt, anhand der tatsächlichen gebuchten Zeitintervalle und der gefahrenen Kilometer, zu erfolgen.
