Innerhalb dieser Gesamtleistung erfolgt Kauf der Standardsoftware (Nr. 4.3 EVB IT Systemvertrag), die Erstellung des Gesamtsystems mit Herbeiführung der Betriebsbereitschaft, inkl. Customizing und Integration sowie Schnittstellen (Nr. 4.5, 4.7 und 4.10 EVB-IT Systemvertrag) sowie - nach Abnahme des Gesamtsystems - Systemservice, einschließlich Wiederherstellung und Aufrechterhaltung der Betriebsbereitschaft sowie der Lieferung neuer Programmstände (Nr. 5.1 EVB-IT Systemvertrag) und der Weiterentwicklung (Nr. 6.1 EVB-IT Systemvertrag), einschließlich Schulungen und Dokumentation; diese Leistungen werden weitgehend pauschal vergütet (siehe Preisblatt). Ferner werden vom Bieter optional abrufbare Leistungen angeboten, wie Migration und sonstige Leistungen vor und nach Abnahme, welche grundsätzlich nach Aufwand (Nr. 7 EVB IT Systemvertrag) vergütet werden (siehe auch Preisblatt). Aus dem Kriterienkatalog folgen zwingende A Kriterien (Muss Kriterien), deren vollständige Erfüllung im betriebsbereiten Gesamtsystem geschuldet ist, sowie zusätzlich bepunktete, nicht zwingende B Kriterien, die zu leisten sind, soweit sie im Vergabeverfahren vom Bieter als angeboten ausgewiesen wurden. Zur Laufzeit: Für die Systemserviceleistungen beginnt die Leistungserbringung vertraglich mit dem Tag nach der erfolgreichen Abnahme; vorgesehen ist eine Mindestvertragsdauer von 84 Monaten. Die ordentliche Kündigung des Systemservice ist erstmals zum Ablauf der Mindestvertragsdauer mit einer Frist von 24 Monaten möglich; ohne fristgerechte Kündigung läuft das Vertragsverhältnis auf unbestimmte Dauer fort. Unabhängig davon kann der gesamte EVB-IT Systemvertrag (als Werkvertrag) nach § 648 BGB gekündigt werden; die Kündigungsfolgen ergeben sich aus Nr. 18.7 EVB-IT Systemvertrag. Hinweis auf abweichende Vertragslängen: Während der Softwarekauf auf Dauer angelegt ist, läuft der Systemservice mindestens 84 Monate und ist danach ordentlich kündbar.
