Terms of use

The terms for using Inteliwert: the website, the dashboard, the read API, the MCP server and the plans.

Last updated: 3 November 2026

1. Scope and operator

These terms of use are the general terms and conditions of Bandpey GmbH, Gmunder Str. 20b, 81379 Munich, Germany (“we”, “us”) for Inteliwert: the website inteliwert.com, the dashboard at dashboard.inteliwert.com, the read API and the MCP server at api.inteliwert.com, accounts and plans.

They apply to everyone who uses Inteliwert. Paid plans are sold only to businesses within the meaning of section 14 of the German Civil Code (BGB), such as companies, freelancers and sole traders acting for their trade or profession, and to legal entities under public law. Where a section applies only to accounts or only to paid plans, it says so.

An individual agreement with us, such as an Enterprise or API Business contract, takes precedence over these terms. Your own terms and conditions do not apply, even if we do not object to them.

2. Definitions

Inteliwert
The website, the dashboard, the read API, the MCP server and the features they offer.
Account
Your personal access to Inteliwert, with your email address as its sign-in.
Workspace
Where an account’s library, settings and plan live. A new account has a workspace of its own, in which it is the owner; the owner and admins manage the workspace’s plan and members.
Plan
Free, Starter, Pro, the API plans or Enterprise, with the prices and allowances on the pricing pages.
Credits
The unit in which AI work counts against a plan’s allowance.
Public data
Notices, company data, statistics and links to documents from public sources, as Inteliwert shows them.
Your content
What you or your workspace put into Inteliwert: uploaded files, connected sources, notes, questions and settings.

3. The service

Inteliwert imports public procurement notices from official sources, makes them searchable, and links every fact to the official notice with the time it was last checked. Without an account, you can search, read opportunity pages, statistics and company profiles, and use the read API and the MCP server within their limits. With an account, you also use the dashboard: a private library for your own documents, with search and answers that cite their passages, and AI work counted in credits.

Which sources Inteliwert imports, and what they do not cover, is on the coverage page. No source is complete. We do not promise that a particular notice, source or document is included, current or correct.

Inteliwert is in a public beta. We develop it continuously and may change, extend or reduce its features. If we remove a substantial feature of a paid plan, we tell the workspace’s owner by email in advance, and the owner may cancel the plan with effect from the change.

4. Information, not advice

Inteliwert gives information. Statements about sources and coverage describe what Inteliwert imports today; they may change and are not a binding offer, a promise of a source, or a guarantee of a result.

Guides and other content about public procurement and funding are general information. They are not legal advice or bidding advice, and they may simplify a subject. Check that they fit your situation before you rely on them, and get professional advice where a decision needs it.

For any tender or grant, the official notice and the procurement or call documents published by the contracting authority or funding body are authoritative. Check deadlines, eligibility, requirements and other conditions at the official source.

Where Inteliwert shows companies that might fit a tender, these are possible matches from public award history. They are not an assessment of fit, eligibility, suitability or reliability.

Contracting authorities publish clarifications, corrections, new documents and changed deadlines on their own portals and in official notices. Inteliwert shows what it imported and when it last checked it, and it can miss a change or show it late. You remain responsible for following the contracting authority’s official communications and for meeting every deadline.

5. AI features

Answers, summaries, transcripts and other results of the AI features are produced by AI models. They can be incomplete or wrong, even where they cite a passage. Check a result against the passage it cites and against the official documents before you rely on it.

Inteliwert prepares evidence. It does not write your bid or application, and it submits nothing to a portal or a contracting authority.

We do not use your content, your questions or the answers to train AI models.

6. Accounts

The contract for a free account is concluded when you first sign in. If you open an account or buy a plan for an organisation, you confirm that you may act for it, and the organisation is our contract partner.

An account is for one person. Do not share your sign-in, not even with colleagues: each person uses their own account, and a team uses the seats of a Pro plan.

Keep access to your email account, and to your account at Google, Microsoft or LinkedIn if you sign in with one, secure. Tell us at once if you think someone else uses your account.

In a workspace, its owner and admins decide who belongs to it and what each member may do; only they buy, change or cancel its plan.

7. Plans, credits and payment

The plans, their prices and their allowances are on the pricing page and the API plans page. Prices are net, plus VAT. The prices and allowances shown when you order apply.

Ordering. An owner or admin of a workspace orders Starter, Pro, API Starter or API Growth through Stripe Checkout, billed monthly or yearly. The contract for the plan is concluded when the order is completed in Checkout. The plan starts when Stripe confirms the payment; a payment by SEPA Direct Debit can take a few days. Enterprise and API Business are agreed individually.

Billing and renewal. A plan is billed in advance for each billing period, through Stripe, and renews automatically for another period of the same length unless it is cancelled. Invoices and receipts come from Stripe by email.

Changes and cancellation. In the billing portal, an owner or admin can change the plan, the number of seats or the billing interval; a change takes effect at once and is charged or credited pro rata. They can cancel a plan at any time with effect from the end of the current billing period; the plan runs until then, and the workspace then continues on the free plan. Fees for a period that has started are not refunded, unless the law requires otherwise.

Credits. Each plan includes the credits shown on the pricing page, with a daily limit. Included credits reset with the plan’s period and do not roll over. Top-up packs for paid plans are used after the included credits and are valid until the end of the subscription year. Credits have no cash value and cannot be transferred, paid out or refunded. When credits run out, AI work pauses until they reset, and search, pages and documents keep working. Free AI work also shares a daily budget, after which it pauses until midnight, Berlin time. Nothing is charged automatically on top of a plan.

Late payment. If a payment fails, the plan stays active while Stripe tries again; seven days after the payment fell due, AI work stops until it succeeds. If it does not succeed, the plan ends and the workspace continues on the free plan; its content is kept.

Price changes. We announce a change to the price of a running plan by email to the workspace’s owner, at least 14 days before the end of a monthly period and at least six weeks before the end of a yearly period. The new price applies from the next period; the owner can cancel before then.

Free use and limits. Search, the pages, the read API and the MCP server are free within the limits stated on the pricing page and the developers page. We may change these limits; we announce a change on the pricing page.

8. Acceptable use

Use Inteliwert lawfully and respect the rights of others. In particular, do not:

  • scrape Inteliwert: retrieve its pages or data systematically with crawlers, scrapers or other automated tools, other than through the read API, the MCP server and the Markdown versions of the pages within their published limits, or as our robots.txt allows
  • exceed or work around limits, quotas or bot protection, for example with several accounts or changing IP addresses
  • redistribute data from Inteliwert in bulk beyond what the licence of its source allows
  • reverse engineer, decompile or disassemble the software, except as far as the law allows it
  • introduce malicious software, probe or attack the security of the service, or try to reach data or areas not meant for you
  • upload unlawful content, content that infringes the rights of others, or files you know or suspect to contain malicious code
  • use our contact channels for fraud, impersonation, harassment or unsolicited bulk messages

We protect Inteliwert with technical measures such as rate limits, bot protection and the detection of automated access. If there are specific indications that an account breaches these terms, we may block its access temporarily, remove the content concerned, or end the contract for good cause. We take your legitimate interests into account and, where it is reasonable, warn you first.

9. Your content and uploads

Your content stays yours. You give us the right to store, copy and process it, including reading the text of scans, transcribing recordings, indexing it and processing it with AI models, only as far as needed to provide Inteliwert to you and your workspace. We do not publish your content, show it to other workspaces or use it to train AI models.

What you confirm. You upload a file or connect a source only if you are entitled to, and only if you may disclose it, for this processing, to us and to the service providers that run Inteliwert for us, named in the privacy notice. This applies in particular to documents you received under confidentiality terms, such as tender documents, and to personal data of other people, for which you need a legal basis. You are responsible for your content being lawful.

If a third party makes a claim against us because your content infringes its rights, and you are responsible for that, you indemnify us against the claim and the reasonable costs of our legal defence.

We do not check your content. We may block or remove content where there are specific indications that it is unlawful, and we tell you unless the law forbids it. We look at your content only where you ask us to, for example in a support request, or where the law requires it.

Keep copies of documents that matter to you outside Inteliwert. We replicate workspace data continuously, but we cannot rule out every loss.

10. Intellectual property

Inteliwert’s text, graphics, designs and software are protected by copyright and other rights that belong to Bandpey GmbH or to the relevant rights holders. Inteliwert and its logo are marks of Bandpey GmbH.

Notices keep the licence of their source, which each record names, and Inteliwert’s statistics are published under CC BY 4.0. These terms do not restrict what those licences allow.

Names of public portals, publications offices, AI assistants and other products belong to their owners. We use them only to describe sources and the assistants Inteliwert is designed to work with. That does not mean they endorse Inteliwert or partner with us.

You may browse the website, and download or print material for your own use or to evaluate Inteliwert, if you keep the copyright and other notices and do not present changed material as ours. The press kit says how to use the logo and the boilerplate to refer to Inteliwert. For any other use, such as copying, republishing, distributing or selling material, ask the rights holder first.

This does not restrict statutory exceptions or rights that cannot lawfully be excluded.

11. Example data

Illustrations of the product on this website use fictional example data, such as the buyer “Stadt Musterstadt”, and are labelled as examples. They show how Inteliwert works. They are not real notices or results, and they say nothing about any real contracting authority, funding body or company. Search results and opportunity pages show real notices from official sources.

12. Messages you send us

Only send information you are entitled to share, and keep it to what we need to answer you. Please do not send credentials, keys, trade secrets, customer data or other confidential material by email.

Sending a message does not create a duty of confidentiality, and it does not transfer ownership of what you send. You keep your rights, and you do not give us a right to publish it or to use it to train AI models.

We do not invite unsolicited ideas or inventions. If you send one, we are not obliged to evaluate, use or pay for it, and it does not stop us developing similar ideas independently.

How we handle your message is described in the privacy notice.

14. Availability and support

We aim for a useful, accurate and working service. In the public beta we promise no particular availability, unless an individual agreement does. Maintenance, faults and changes can interrupt access.

Support is by email at hello@inteliwert.com, in English or German.

15. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under a guarantee we have given, for defects we fraudulently concealed, and under the German Product Liability Act.

For slight negligence, we are liable only for the breach of an essential contractual obligation, one whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely, and only for the damage typical of the contract and foreseeable when it was concluded.

For what Inteliwert offers free of charge (use without an account, a free account, and the read API and the MCP server within their free limits), we are liable, apart from the cases in the first paragraph, only for intent and gross negligence.

If data is lost, we are liable only for the effort it would have taken to restore it had you kept your own copies as these terms ask. Beyond this section, our liability is excluded; this also applies to the personal liability of our employees, representatives and agents.

Liability under data protection law and your mandatory rights as a consumer are not affected.

16. Term and termination

A free account runs for an indefinite period. You can end it at any time by writing to hello@inteliwert.com; we can end it with four weeks’ notice by email.

A paid plan runs for its billing period and renews as described under “Plans, credits and payment”. Cancelling a plan ends it at the end of the period; the workspace then continues on the free plan.

Either side may end the contract for good cause without notice. Good cause for us includes in particular a serious breach of “Acceptable use”, or a repeated one despite a warning, and a payment that remains unpaid. Fees already paid are not refunded in that case, unless the law requires otherwise.

When your account ends, we delete it with its workspace and library, as the privacy notice describes. Keep copies of what you need before then.

17. Changes to these terms

We may change these terms for a valid reason, such as a change in the law, in case law or in Inteliwert. We send the change to account holders by email at least four weeks before it takes effect, with the new version and what changes.

If you do not object in text form, for example by email, before the change takes effect, the new version applies to your contract from then on; the email points this out. If you object, the previous version continues to apply, and either side may end the contract with effect from the date of the change.

For use without an account, the version published here when you use Inteliwert applies. The date at the top shows the latest version.

18. Privacy and cookies

What Inteliwert processes about you, and what it stores in your browser, is described in the privacy notice and on the cookie settings page. These terms are not privacy information, and they are not consent to any processing.

19. Governing law and courts

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not take away the protection of the mandatory law of the country where they habitually reside.

If you are a merchant, a legal entity under public law or a special fund under public law, the courts of Munich have exclusive jurisdiction for all disputes arising from the contract; we may also sue you at your general place of jurisdiction. Otherwise the courts the law determines are competent, and a consumer’s mandatory right to sue where the law allows it is not restricted.

20. Final provisions

We may use subcontractors to provide Inteliwert, such as our hosting and payment providers. We remain responsible for them and make sure that they observe data protection and security.

Declarations under these terms may be made in text form, for example by email.

If a provision of these terms is invalid or does not become part of the contract, the rest remains in effect, and the law decides what applies in its place.

21. Contact

Questions about these terms: hello@inteliwert.com. Provider details are in the imprint.
