Gegenstand des Auftrags ist die Beschaffung von 80 ITAR-freien Feststoffraketenmotoren des Typs ,RED KITE‘ zur Absicherung des zukünftigen Bedarfs für Höhenforschungsraketen-Missionen der DLR-MORABA. Die Leistung umfasst die Herstellung, Qualifikationsüberwachung und Lieferung der genannten Triebwerkseinheiten nebst zugehörigem Zubehör. Die Vergabe erfolgt im Wege eines Verhandlungsverfahrens ohne vorherige Bekanntmachung gemäß § 14 Abs. 4 Nr. 2 VgV. Ein Wettbewerb ist aus technischen Gründen sowie zum Schutz von Ausschließlichkeitsrechten nicht vorhanden, da die Bayern-Chemie GmbH der alleinige Entwickler und Inhaber der Herstellungsrechte dieses spezifischen Motorentyps ist. Das Fehlen von Marktalternativen wurde im Vorfeld durch eine 30-tägige, EU-weit veröffentlichte Markterkundung objektiv überprüft und bestätigt. Im Rahmen dieses transparenten Aufrufs ging die Bayern-Chemie GmbH als einziger qualifizierter Interessent hervor.
